JW Michaels is engaged with a MAJOR health and wellness client seeking a privacy lawyer to join their team as Senior Counsel - Privacy to help accelerate their development of cutting edge products and services that use technology to both add value to their customers and uphold the Client's data stewardship principals.
The ideal candidate will have a technology background, true fluency in the legal and practical components of data protection as applied to the product lifecycle gleaned from considerable experience at a major law firm or public company, and a demonstrable history of solving complex, time-sensitive problems in close partnership with a variety of cross-functional stakeholders. The selected candidate will be a senior leader on the Data Privacy team within Client’s world-class Legal & Compliance Organization, and manage a team of supporting privacy professionals.
Description
Responsibilities for this role will include:
- analyze existing privacy processes and proposed new processes to ensure compliance with applicable laws and modify/improve processes to conform to existing law;
- collaborate with IT and other internal stakeholders to implement new and revised privacy processes (e.g., re privacy rights requests, opt outs, etc.) with respect to consumers, employees and vendors;
- be able to answer internal and external privacy-related questions and inquiries;
- assume responsibility for managing and updating our PI data catalog;
- review existing contracts, and draft and negotiate new contracts, for privacy compliance;
- monitor and summarize new and evolving privacy laws, both in the U.S. and Canada;
- manage and update internal and external privacy policies, notices, and procedures;
- provide expert legal advice on privacy, cybersecurity, data use, and technology matters
- advise on data, cyber, and privacy-related issues in M&A transactions;
- conduct privacy impact assessments for proposed rules or systems;
- provide privacy trainings, as needed;
- understand adtech, cookies, online trackers, etc.;
- assess potential privacy/cybersecurity risks;
- be familiar with data breach laws.
REQUIRED Candidate Criteria (Please read carefully):
- 5 to 8 years of post JD of experience with a demonstrable focus on privacy;
- Strong privacy training either at a top law firm (AmLaw100 or TOP Boutique) or as in-house counsel focused on privacy;
- Strong working knowledge of relevant global privacy and data security laws, rules, and regulations, (e.g., CCPA, VCDPA; FTC Act/Section 5; GLBA; FCRA; state biometric privacy laws and others);
- Experience in data analytics and data science, and identifying the privacy-related considerations for each considered a strong asset;
- Exceptional collaboration and relationship-building skills
- Positive, optimistic outlook that thrives in a fast-paced, dynamic, sometimes ambiguous environment
- Excellent communication skills and an ability to explain complex concepts effectively to business teams
- Solution and results oriented, with the ability to prioritize and deliver key initiatives
- *MUST* be willing to be onsite in person 3 days/week;

Preferred Candidate Criteria (Please read carefully):
- 3+ years privacy training at an AmLaw100 firm (or top privacy boutique);
- experience inhouse with a major, global adtech or consumer retail services corporation
- CIPP or CIPT certification
